Muss ich steuerfreie Gewinne trotzdem angeben?
Technisch nein — steuerfreie Gewinne aus der 1-Jahres-Regel müssen nicht in der Steuererklärung angegeben werden. Wir empfehlen dennoch, alle Transaktionen vollständig zu dokumentieren, falls das Finanzamt nachfragt.
Gilt die Steuerfreiheit auch bei sehr großen Gewinnen?
Ja. Bei Kryptowährungen gibt es keine Obergrenze für die Steuerfreiheit nach § 23 EStG. Ob der Gewinn 2.800 € oder 2.800.000 € beträgt — nach über 365 Tagen Haltefrist fällt keine Steuer an.
Was passiert, wenn ich Teil der ETH früher verkaufe?

Unlike Germany’s complete tax exemption after 1 year, the US still taxes long-term gains, but at a significantly lower rate than ordinary income.

Do I need to report long-term gains if my rate is 0%?
Yes. Even at a 0% tax rate, you must still report the sale on Form 8949 and Schedule D. The 0% rate means no tax owed, not no reporting required.
Does the long-term rate apply to all cryptocurrencies?
Yes — all crypto held more than 1 year qualifies for long-term capital gains rates, regardless of the coin. Bitcoin, Ethereum, Solana, and all other cryptocurrencies are treated the same way under IRS Notice 2014-21.
What if I sell part of my ETH earlier?
Each lot is tracked separately. The IRS allows FIFO, HIFO, or specific identification. If you sell a specific lot that was held under 1 year, that portion is a short-term gain. Use your exchange’s tax reporting tools or a crypto tax platform to track per-lot holding periods.
